The turn of the year was particularly busy for the lawyers of KIEŁTYKA GŁADKOWSKI KG LEGAL. Our team has been trusted by representatives of top law firms and global business corporations. Since the profile of the law firm is a result of experience, we would like to present flagship cases that, like in a lens, focus the profile of our law firm specializing in cross-border cases:
1/ CROSS-BORDER TRANSACTION OF THE SALE OF THE WORK OF ART – unique transaction value
Our team dealing with cross-border matters supported with its legal services the world’s most renowned British auction house, which mediated in the sale of a handwritten document of one of the most important artists of Polish origin to a Polish cultural institute established under a separate Polish act.
KIEŁTYKA GŁADKOWSKI advised on:
– negotiation of payment security under the direct public procurement procedure and budget subsidy from the Ministry of Culture for the purchase of a work;
– representing an intermediary selling the work of art in the procedure of temporary transit of the work for auction purposes before customs authorities;

2/ LIFE SCIENCES SECTOR – MODERN DRUG IN CLINICAL TRIALS
KIEŁTYKA GŁADKOWSKI lawyers specializing in advising on pharmaceutical law advised an international corporation on the problem of whether and how the manufacturer of a very expensive drug can be obliged to administer the drug to participants of a clinical trial.
The main focus of KIEŁTYKA GŁADKOWSKI’s legal support was on the lack of regulations – the compassionate use procedure, i.e. the possibility of operating on a drug without appropriate permits, as well as on the possibilities of using extended access;
3/ as part of the specialization in new technologies and cross-border corporate law, KIEŁTYKA GŁADKOWSKI is currently assisting in the transfer of modern optosensory technology for eye tracking to an American entity for the purpose of selling the technology to an American investor.
The main concept of technological transfer from a Polish capital company to an American shelf company is the use of a classic tripartite construction of civil law transfer. KIEŁTYKA GŁADKOWSKI adapts proven classic legal mechanisms to the needs of new technologies.
4/ KIEŁTYKA GŁADKOWSKI litigation team is currently conducting:
– enforcement against the real estate of a Polish debtor based on the procedure for recognizing foreign bankruptcy in Polish jurisdiction.
– another interesting case is the representation of a foreign global manufacturer of medical devices before the Polish court in a case concerning a claim of personal injury to a patient caused by the manufacturer’s medical device, where the dispute concerns the dispute whether manufacturer’s liability is based on fault or risk;
– another court dispute demonstrating the capabilities of our law firm is securing the solvency of a debtor (applying for security measure) operating in the entertainment and television industry so that our client based in South America can effectively enforce the challenged debt.
5/ in the scope of purely corporate labor law in Poland, a prime example is legal work carried out for one of the global architectural studios of the creator of the largest office building in Poland, for which our lawyers designed employee policies, taking into account the global and complex structure of the employer and ESG requirements, including the latest implemented EU regulations in connection with the Client’s involvement in the construction of a large airport.
