International contract law for e-sport industry

In the coming days, the lawyers of KIEŁTYKA GŁADKOWSKI LEGAL will take part in a webinar organized by a law firm with its offices in Los Angeles, Silicon Valley, New York, Chicago and Phoenix, devoted to “Securing brand value in E-sport in individualized agreements such as “TALENT CONTRACTS”.

Talent contract, becoming increasingly more popular in the Polish legal market, is a kind of a very characteristic civil law contract, used in legal practice, for example, to regulate the legal relationship between an investor and a “performer” in the sports, advertising, artistic and other freelance industries.

Interest in this type of agreements from the American jurisdiction results from the fact that KIEŁTYKA GŁADKOWSKI LEGAL participates in cross-border cooperation for foreign clients in projects of contractually securing legal interests from the perspective of the rights of the creator and producer of new technologies for products intended for the professional sports sector, such as utility equipment using artificial intelligence (for example: augmented reality glasses).

Participation in the webinar of KIEŁTYKA GŁADKOWSKI LEGAL team is based on:

  • seeking legal solutions in the implementation of solutions for the protection of patent and property rights (including license rights) of software copyrights;
  • exchange of experience as to the practical effectiveness of contractual clauses relating to the protection of the software producers against liability resulting from the legal regulations (including the European Union) concerning dangerous products;
  • effective legal solutions in creating contracts between the organizers of e-sport games and their participants; especially with regard to issues such as image protection, remuneration, financial conditions for participation in professional e-sport events, as well as issues related to sponsorship, streaming royalties; legal rules for using the equipment.

KIEŁTYKA GŁADKOWSKI KG LEGAL participates in the cross-border consultations of the European Commission regarding Regulation (EC) 805/2004

KIEŁTYKA GŁADKOWSKI KG LEGAL was addressed to participate in cross-border expert consultations as part of one of the European Commission’s projects aimed at supervising the application of the European Union law. As part of the project, managed by a renowned global audit institution based in Brussels, KIEŁTYKA GŁADKOWSKI KG LEGAL was asked to evaluate the application of the Regulation (EC) 805/2004 of 2004 establishing a European Enforcement Order for uncontested claims.

The study is intended to assess the functioning of the provisions of the Regulation (EC) 805/2004 and the judicial practice of using the European Enforcement Order in individual jurisdictions.

In particular, the assessment will concern the functioning of the Regulation (EC) 805/2004, based on the current practice, and its comparison with the initial assumptions underlying the adoption of this EU act, also taking into account possible cases of incorrect application of the Regulation or the resulting undesirable effects.

Particular emphasis will be put on the application of the Regulation after the Brussels I-bis Regulation (Regulation (EU) No 1215/2012 of the European Parliament and of the Council of 12 December 2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters).

As part of the consultations, there have been undertaken research activities, including interviews at national level such as expert teleconferences. On the basis of the conducted research and analyses, a detailed report on the functioning of the European Enforcement Order in Poland will be prepared.

Based on its knowledge of legal and business environment and cross border expertise, Kieltyka Gladkowski KG Legal is launching its new project – iSTART1, the accelerator that will offer programs to help scaling rising businesses, provide access to mentoring programs, investments in companies as part of accelerator programs, access to investors and further capital, connection with the recipients of the technology interested in the development and implementation of the products or services offered by the start-ups.

Part of the accelerator will also be dedicated to shareholder crowdfunding and digital shareholders. The accelerator will offer equity crowdfunding, reward crowdfunding and donation crowdfunding.

iSTART1 will be in a major part focused on tech and med companies, primarily involving projects within IoT, including virtual and augmented reality (VR / AR), artificial intelligence (AI) and cyber security. Part of the activity of iSTART1 will concentrate on the start-ups that develop solutions to fight COVID-19.

The accelerator has been created based on the involvement and funding of international clients and partners of Kieltyka Gladkowski KG Legal.
